Terms of Service

These Terms of Service ("Terms") govern your access to and use of CourseConverter (the "Service"), a course-authoring tool operated by Leigh Burke, a sole trader trading as CourseConverter ("CourseConverter", "we", "us", or "our"), based in Victoria, Australia. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Your account
You must provide accurate information when creating an account and are responsible for activity that occurs under it. You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. You are responsible for keeping your login credentials secure. We use Google OAuth for sign-in; your use of Google's authentication is also subject to Google's terms.
2. Your content and intellectual property
You own your content. Any course material, documents, text, images you upload, and courses you create ("Your Content") remain yours. We do not claim ownership of Your Content.
To operate the Service, you grant us a limited, non-exclusive, worldwide licence to store, process, host, display, and transmit Your Content solely for the purpose of providing the Service to you — for example, saving your courses, generating exports, and storing uploaded media. This licence ends when you delete Your Content or close your account, except where retention is required for legal or operational reasons (such as backups, which are purged on a rolling basis).
You are responsible for ensuring you have the rights to all content you upload, and that Your Content does not infringe the intellectual property, privacy, or other rights of any third party, and is not unlawful, harmful, or objectionable.
The Service itself — including its software, design, branding, and documentation — is owned by CourseConverter and protected by intellectual property laws. These Terms do not grant you any right to our trademarks or branding.
3. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law;
- Upload content that is illegal, infringing, defamatory, or that sexualises or endangers minors;
- Attempt to reverse-engineer, disrupt, overload, or gain unauthorised access to the Service or its infrastructure;
- Resell, sublicense, or white-label the Service without our written permission;
- Use the Service to distribute malware or to harvest data about other users.
We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice where we reasonably believe it necessary to protect the Service or other users.
4. Third-party content and stock media
The Service provides access to stock images via the Pexels and Pixabay libraries. Images sourced through these libraries are subject to the Pexels Licence and the Pixabay Content Licence respectively. You are responsible for complying with those licences when you use such images in your courses — including any restrictions on identifiable people, trademarks, or sensitive use. CourseConverter does not own these images and provides access to them as a convenience only.
5. Subscriptions, billing, and refunds
The Service offers a free tier and paid subscription plans. Paid plans are billed in advance on a monthly or annual basis through our payment processor, Stripe. Prices are shown in US dollars unless stated otherwise.
- Renewal: Subscriptions renew automatically at the end of each billing period unless cancelled beforehand.
- Cancellation: You may cancel at any time from your billing settings. Cancellation takes effect at the end of the current billing period; you retain paid access until then, after which your account moves to the Free plan.
- Refunds: We offer a 14-day money-back guarantee on new paid subscriptions. If you are not satisfied, contact us within 14 days of your initial payment for a full refund. Renewal payments are generally non-refundable, though we will consider reasonable requests.
- Downgrades: If you downgrade or move to the Free plan and exceed that plan's limits (for example, the number of courses), excess courses may become read-only until you are within the limit again. Your content is not deleted.
- Price changes: We may change prices with reasonable notice. Changes do not affect the current paid period.
6. Exports
The Service lets you export courses as SCORM 1.2 packages and standalone HTML. You are responsible for how you host, distribute, and use these exports. Exported files are yours to use in accordance with these Terms and any third-party licences (such as stock media licences) applicable to their contents.
7. Service availability
We aim to keep the Service available and reliable but do not guarantee uninterrupted access. The Service may be unavailable from time to time for maintenance, updates, or reasons beyond our control. We are not liable for any loss arising from downtime.
8. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, except those that cannot be excluded under applicable law (including the Australian Consumer Law). We do not warrant that the Service will meet your requirements or be error-free.
9. Limitation of liability
To the maximum extent permitted by law, CourseConverter will not be liable for any indirect, incidental, special, or consequential loss, or any loss of data, profits, or revenue, arising from your use of the Service. Where liability cannot be excluded but can be limited, our total liability is limited to the amount you paid us for the Service in the 12 months preceding the claim.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you may have under the Australian Consumer Law that cannot be lawfully excluded.
10. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms. On termination, your right to use the Service ends; provisions that by their nature should survive (such as IP ownership, disclaimers, and limitation of liability) will survive.
11. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you (for example, by email or an in-app notice). Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
12. Governing law
These Terms are governed by the laws of the State of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of that State.
